My Shortlist

You are not required to register to use the Website. However certain features on the Website may only be available if you do register or join, for example 'My Shortlist', which allows you to create a list of your favourite properties. You should keep any user name and password that are allocated to you private, and not disclose them to any other person. If you have lost or forgotten your password, you can request that we send an email to your registered email address allowing you to reset your password.

By adding a property to your property shortlist in the Website you are asking to receive email alert updates from the Website for status changes to each property, for example a price change or if the property is sold. If you no longer wish to receive email alerts from the Website for a property listed in your the Website shortlist, you can individually remove the email alert for each property by following the link at the bottom of the email alert.

For saved search alerts, you can edit the frequency of receiving the alert by selecting the ' Edit Alert' link under each search in the Website. The default frequency is daily. You can turn off alerts for a search by selecting the 'Turn alert off' link under each search (this link only appears if there is an alert set up).

Email services

the Website provides various ways for you to receive emails from us, for example alerts when new listings are made available if you have joined the Website and saved a search. You can manage these emails and elect not to receive them using the tools available on the Website, or by contacting us using one of the methods described on the "contact us" page.

the Website also allows other users to send you emails about content on the Website, for example our "email a friend" function. We do not control the users of the Website and cannot be held responsible for emails that may be sent to you in this manner. If you send an email of this type, you must ensure that the recipient wishes to receive the email. If any term, condition or warranty is implied into these terms and conditions and we are able to limit your remedy for a breach of such a term, condition or warranty, then our liability for breach of the term, condition or warranty is limited to one or more of the following at our option:

in the case of goods, the replacement of the goods or the supply of equivalent goods, the repair of the goods, the payment of the cost of replacing the goods or of acquiring equivalent goods, or the payment of the cost of having the goods repaired; or

in the case of services, the supplying of the services again, or the payment of the cost of having the services supplied again.

Subject to our obligations under the implied terms, conditions or warranties referred to above, and to the maximum extent permitted by law, our maximum aggregate liability for all claims under or relating to these terms and conditions, whether in contract, tort (including negligence), in equity, under statute, under an indemnity, based on fundamental breach or breach of a fundamental term or on any other basis, is limited to an amount equal to AUD$100. In calculating our aggregate liability under this paragraph, the parties must include any amounts paid or the value of any goods or services replaced, repaired or supplied by us for a breach of the implied terms, conditions or warranties referred to above.

Subject to our obligations under the implied terms, conditions or warranties referred to above, and to the maximum extent permitted by law, we are not liable for, and no measure of damages will, under any circumstances, include:

special, indirect, consequential, incidental or punitive damages; or

damages for loss of profits, revenue, goodwill, bargain, anticipated savings or loss or corruption of data,

whether in contract, tort (including negligence), in equity, under statute, under an indemnity, based on fundamental breach or breach of a fundamental term or on any other basis, whether or not such loss or damage was foreseeable and even if advised of the possibility of the loss or damage.

Our liability to you is diminished to the extent that your acts or omissions (or those of a third party) contribute to or cause the loss or liability.

Limitations of Liability

To the maximum extent permitted by law no party involved in creating, producing, or delivering the Website manager will be liable for any direct, incidental, consequential or indirect damages, loss or corruption of data, loss of profits, goodwill, bargain or opportunity or loss of anticipated savings resulting from your access to, or use of, or inability to use the Website manager, whether based on warranty, contract, tort, negligence or any other legal theory, and whether or not we know of the possibility of such damage.

These terms and conditions are governed by the laws of New South Wales, Australia, and you irrevocably submit to the exclusive jurisdiction of the courts of New South Wales, Australia.

These terms and conditions constitute the entire agreement between us and you in relation to the Website and supersede all other (prior or contemporaneous) communications or displays whether electronic, oral, or written, between us and you in relation to the Website.

Your use of the Website is conducted electronically and you agree that we may communicate with you electronically for all aspects of your use of the Website, including sending you electronic notices.

The provisions of these terms and conditions which by their nature survive termination or expiry of these terms and conditions will survive termination or expiry of these terms and conditions.

The word "including" when used in these terms and conditions is not a term of limitation.
